Fighting for Due Process in Oregon

Imagine waking up from a medical emergency, being cleared by a doctor to go home, and getting behind the wheel, only to realize you are technically committing a Class A Misdemeanor. Not because you did something wrong, but because the law considers you "notified" the second a letter hits the mail, even if it takes three weeks to reach your mailbox

Under ORS 809.430, the DMV considers a driver notified of a suspension the moment a letter is postmarked. For those of us in rural Oregon, mail transit and recovery time create a "Due Process Gap." I recently faced a 21-day delay in receiving a medical suspension notice. During those three weeks, I could have been arrested for a crime I had no way of knowing I would have committed. I’ve drafted a legislative concept for the 2026 Short Session: The Actual Notice & Medical Due Process Act. It proposes a "Triple-Channel" notification system:

  • Digital Alert: Immediate SMS or email notification.

  • First Class Mail: The traditional paper trail.

  • Substituted Personal Service: Ensuring drivers are actually notified before they are criminalized.

This is exactly why I started this platform. Whether it’s working with Representative Bobby Levy or Senator Todd Nash, the goal is to close the gaps where the law fails the people it’s meant to protect. I am a USMC veteran, a constituent in Union, and a Pre-Law student. I believe that Lex (the law) must always serve Liberty (the person). Stay tuned as we track the progress of this bill in the 2026 session.

Legislative Status: The "Actual Notice & Medical Due Process Act" is a proposed legislative concept for the 2026 Short Session. It has been submitted to the offices of Senator Todd Nash, Representative Bobby Levy, and other members of the Oregon Legislature for consideration. Veteran Owned: This project is founded and operated by a USMC veteran and constituent in Union, Oregon.
